Careless Driving
Under the Highway Traffic Act, (HTA) Careless Driving is one of the most serious offences under the Act.  It comes with 6 demerit points and can significantly affect the insurance rates you are charged.  Most people are so intimidated by these facts that they jump at any offer of reduced charge that the prosecutor offers.  They end up pleading guilty to offences like following too closely or failing to turn in safety, not realizing that, effectively, they may have been 'played' by a system that appears to encourage or at least condone overcharging in order to exact a guilty plea to a lesser offence.

Careless driving is in fact very difficult to prove.  Forstner Law can look at your case and give you a good sense of whether the charge of Careless Driving is a good fit for what actually happened.  If it isn't you should almost never plead guilty to Careless Driving, nor should you necessarily plead guilty to a lesser charge if it  is offered by the prosecutor.  These days police are encouraged to get accidents off the road as quickly as possible.  If they do not draw diagrams, interview witnesses, or do all the other things that constitute an investigation, there is often not enough evidence to prove the case of careless driving.

Stunt Driving
Stunt Driving is equally serious.  It is a charge that will look very bad on your driving record.  Under the HTA, stunt driving can be charged for many different reasons.  It is important to get legal advice as to whether the charge was appropriate.  If it was not, Forstner Law can advocate for you to get the charge reduced, or to take the case to trial.
