Impaired Driving Lawyer in Oshawa ON

Impaired driving, Over 80, and Refuse to provide a sample are complicated provisions of the Criminal Code. If you are facing any of these,  you require the assistance of a trained, legal professional.  Lawrence can help.  Impaired driving is defined as having care or control of a motor vehicle, whether or not it is in motion, while the person's ability to operate the vehicle is impaired by alcohol or drugs or having consumed alcohol in such quantity that it exceeds eighty milligrams in one hundred millilitres of blood.  If a police officer has reasonable grounds to suspect that a person has alcohol or drugs in their body and has operated a motor vehicle within the preceding three hours, the officer may demand physical coordination tests or a breath sample.  Failure to comply with these demands is also a criminal offence.

Cases involving driving offences are full of legal issues, which means that there are several defences to charges of impaired operation of a motor vehicle available under the law that may apply to you.  If the police fail to comply with technical requirements stipulated in the Criminal Code in relation to the breath demand they made of you, the period of time within which it was made or an approved instrument was not used by someone qualified to operate the instrument, your test results may be deemed inadmissible in court.  Convictions for driving offences include penalties of license suspensions, fines and even possibly jail time, as well as the stigma of a criminal record and implications in regards to your employment opportunities.  Let Lawrence put his in-depth knowledge of the law to work for you.  Call now at (289) 316-2573.  Let Lawrence take some of the weight off your shoulders.
